CURRENT SDC/LOCAL 1613 DISCUSSIONS INDEX

This index is provided to inform union members of issues being discussed between
management and the union in the
U.S. Border Patrol,
San Diego Sector. Current Documents listed as "PRIVATE" are those files which may not be
disclosed in a public forum. Members interested in
learning about "PRIVATE" matters and those issues listed below must attend a union meeting since we do not
have the manpower to respond to phone and/or email requests for information. We will do our best to keep the members
informed, but with time constraints and limited manpower resources, this may not always
be possible. Since the Local 1613 Message Board is open to the public,
discussions concerning ongoing discussions/negotiations WILL NOT be
permitted on the message board.
If you have a solution or
suggestion regarding any of the open issues listed below,
now is your opportunity to share that solution with the Union. Send all your
feedback concerning the issues listed below to
the Representative(s)
identified for the issue by clicking on a representative's name.

"Posted" indicates the date the issue first appeared on the website.

last time the issue was updated (red font
indicates an active matter).

indicates the last date we will accept comments concerning
the issue or the most recent document. The deadline will be updated when discussions are extended or when a
new document is posted so check back regularly to keep informed of the
changes.

designated deadline at this time.

CLOSED indicates
the matter is closed for any further comments.

VACATED
indicates the parties decided/agreed to terminate discussions or
implementation of the proposed idea.
Finally, there appears to be some confusion
regarding the union's obligation to the membership when dealing with these
types of discussions. Local 1613 has over 1200 union members and
this website is the best possible way for union volunteers to keep our
fellow members apprised of our activities and interactions with San Diego
Sector officials. We redesigned the website to provide more information to
our members about the local's business and added several methods for members to
contact union volunteers. We also understand each individual member
has a responsibility to stay informed
with the Local's business. We also understand our
members have other obligations which make it difficult for them to appear at
union meetings. Therefore, if the
local only receives a few opposing viewpoints on a matter presented here or
only a few members show up to a union meeting to oppose something the local
is working on, the
local will assume the majority of the members are in favor of what is
proposed by our union volunteers. Until the local hears otherwise from a majority
of the members, we will operate under the assumption that our membership
agrees with the information presented on our official website.

As per King David Aguilar or one of the LER personnel running the Agency,
sector officials do not have the authority to enter into these discussions
with the Local. Instead, King Aguilar suggests agents apply under the

As per King David Aguilar or one of the LER personnel running the Border
Patrol, SDC does not have the authority to enter into this agreement with
the Local, even though they did it in the past. Instead, LER has
advised SDC to continue operating under existing DMT policies, all of which
are outdated and do not represent the current system of details affecting
field agents. According to King Aguilar, he does not want one of his
high-grade Chiefs to have to encounter Union representatives at a different
Sector who want a policy created in a different sector. We explained
to King Aguilar that a high-grade Chief should be able make a decision to
enter into discussions with low-grade Union officials or tell them he/she is
not interested in their proposal. Now that LER folks are running the
Agency, maybe we can take them on detail with us a couple of times a year,
for 45 day details, and give them two or three days notice, so that they
understand why we want to fix the system.
