In response to the orders to remove the Local 1613 Notices and the NBPC press release related to the vote of "NO CONFIDENCE" in Chief Aguilar, Local 1613 created some new flyers and handouts to be distributed at stations throughout San Diego Sector.  Here are the flyers that will be distributed starting this week.  If you did not receive a copy at your station, please contact your Lead Union representative. 07-11-07

Chief Aguilar and his followers can try to claim that the rank and file do not support the vote of "No Confidence" against him, but we have data that proves otherwise.  Local 1613 conducted a random sampling of over 100 Border Patrol Agents assigned to the San Diego Sector and the results are in:  07-11-07

Union representatives at the Campo and Brownfield station were also ordered to remove the official Union notice from the official Union bulletin boards within each of these stations.  These orders came after Chief Aguilar's visit to San Diego.  These violations will be addressed in subsequent grievances or Unfair Labor Practices.

Local 1613 Lead Union Representatives at Imperial Beach Station and San Clemente Station were ordered to remove an official Union notice from an official Union bulletin board located within each of the stations.  The official Union notice notified bargaining unit members of the vote of "No Confidence", included an official picture of Chief Aguilar, and provided a brief synopsis of the vote.  Yesterday, at the Chula Vista Border Patrol Station, the Patrol Agent In Charge (PAIC) took it upon himself to remove the official Union notice from the bulletin board and then later informed the Lead Station Representative of his actions. Then, the PAIC went back to the Union bulletin board a day later and removed the National Border Patrol Council's official press release on the vote of "No Confidence".  Ironically, Chief Aguilar is coming to San Diego Sector on Friday and Saturday and will be appearing at musters at both the Imperial Beach and Chula Vista Border Patrol Stations.  Grievances were filed regarding two of the incidents and the Union is currently contemplating filing an Unfair Labor Practice for the third violation (Grievance copies: San Clemente BPS and Imperial Beach BPS). 

NOTE: From what we have recently learned, these recent violations were at the direction of the Labor Employee Relations (LER) division.  This should be of no surprise to anyone who has dealt with the LER kingdom since they are responsible for repeatedly providing bad advice to management. Instead of being concerned with improving relations, they are purposely destroying any relations that did exist between management and the Union just so they can justify their existence and build another bureaucratic kingdom paralleling all the other new kingdoms within Homeland INSecurity. Since LER has instructed management not to enter into any discussions with the Union because they have the funds to fight the Union in arbitration, I guess it is time to take a look at where exactly they are using all of the taxpayer's money.  I believe the taxpayers deserve to know why CBP has allocated so much money to fight the frontline agents instead of providing the agents with better equipment to perform their jobs.  05-10-07

Local 1613 conducted a random survey of more than 100 Border Patrol Agents in the San Diego Sector on the following issues and the results are just as shocking as the results to the "No Confidence" poll question 07-11-07:

News Bulletin for Chief Aguilar: click here 09-27-06

The NBPC filed a demand to bargain over this issue (09-29-06).  San Diego Sector notified the Union yesterday of an agreement which was signed by Immigration and Customs Enforcement and the Office of Border Patrol, which will result in all Immigration and Enforcement Agents being pulled out of our detention facilities by tomorrow, September 1, 2006.  Therefore, effective tomorrow, the U.S. Border Patrol will no longer have anyone to handle the detention and transportation of persons apprehended by Border Patrol Agents.  So, while Chief Aguilar tells Congress and the Press how many Border Patrol Agents are working the border thanks to the National Guard, Border Patrol Agents will be pulled off the border again to work detention facilities and transport detainees.  The National Border Patrol Council and Local 1613 are currently reviewing the matter to determine a course of action. 08-29-06

The National Border Patrol Council filed a demand to bargain and a grievance over the standardized shifts (09-16-06).   Once again, Chief Aguilar shows his lack of concern for low morale and  the safety of agents by ordering all Border Patrol stations to operate with the same shift nationwide. 08-19-06
